When council detects a structure built without a building permit, the property owner is served with a building notice, which asks the owner to provide reasons why the illegal structure should not be demolished.

There are circumstances when the owner may wish to retain the illegal structure and can do so by having the structure certified as structurally sound by an Engineer and providing a report from a Private Building Surveyor confirming compliance with all relevant provisions of the Building Regulations and National Construction Code.

It is important that the owner is aware of the expense of the certification process, before committing any time and money.

A Building Order will be served on the property owner with options to demolish and remove the illegal structure or have it certified, and an application forwarded to the Municipal Building Surveyor. An application for the assessment of certification can be submitted via Councils’ website for consideration by the Municipal Building Surveyor. Prescribed fees apply.

If the assessment of the certified documentation is deemed suitable, the structure can be retained, and the Building Order will be cancelled.

The payment of the Assessment of Certification fee does not guarantee the approval of the certification documentation if there are any errors or deficiencies with the submitted documents.
