Proposed changes – Compulsory registration of private pools and spas in Victoria

If you own a pool or spa that can hold a depth of more than 300 millimetres, please note that  legislation is likely to be passed later in 2019 that will mean you need to:  

  •  register it with your local council
  • have its safety barrier inspected by a building/pool inspector every 3 years.

You do not need to do anything yet. When the legislation comes into force, an online form to register your pool or spa will be available on this page.

  • When the legislation is passed, pools and spas in Cardinia Shire will need to be registered with us between 1 December 2019 and 14 April 2020. These proposed dates will be confirmed by the Victorian Government closer to the time.
  1. Register your pool or outdoor spa using the online form that will be available on this web page from 1 December.
  2. Once we receive your registration form, we will give you information regarding when your pool was likely to have been built. This will help you determine when the certificate of compliance for your pool or spa needs to be submitted to Council (see table below).
  3. Hire a building inspector/pool inspector to do an inspection of your pool/spa. You will need to make sure you allow enough time for the inspector to meet the lodgement date (see table below). 
  4. Following the inspection, the inspector will submit a certificate of compliance for your pool/spa to Council. If the pool or spa’s safety barrier does not meet legal safety requirements, the inspector will let you know what changes you need to make in order to meet the requirements.

3 years after the date the certificate of final inspection/occupancy permit is issued for the pool.

 

 

Registration fee: $51

Certificate of compliance lodgement: $30

Non-compliance lodgement: $385 (this is the fee you will need to pay if your pool/spa is inspected and the safety barrier does not meet legal requirements).

You may be subject to fines/penalties.
