Cardinia Shire Council (Council), acting under section 206 and Schedule 10 Clause 3 of the Local Government Act 1989 and section 114 of the Local Government Act 2020, proposes to discontinue the 375m2 of unused section of Trythall Street, Beaconsfield, shown on the plan.

If discontinued, Council proposes to sell the land to the adjoining property (the Purchaser), being the Department of Energy, Environment and Climate Action (DEECA), by private treaty in accordance with Council’s policies and on the following terms and conditions:

  • Price: $1 for the land, understanding the future benefit derived from its incorporation within the future Cardinia Creek Parklands project.
  • Other conditions of sale:
    • The Purchaser must reimburse Council its costs associated with discontinuing the road and selling the land, estimated at between $17,000 - $19,000 plus GST.
    • That part of the land containing South East Water assets will be encumbered with a 3 metre wide easement in favour of the authority post settlement.
    • Also creating a 3 metre wide drainage easement in favour of Cardinia Shire Council post settlement.

Submissions

In accordance with section 223 of the Local Government Act 1989 and as part of its Community Engagement process, Council is inviting submissions on this proposal. Any person wishing to make a submission must do so no later than 5pm Monday 25 August 2025

Please ensure submissions include a heading of ‘Submission for Trythall Street Discontinuance and Sale’.

A person making a submission is entitled to request in the submission that they wish to appear in person, or to be represented by a person specified in the submission, in support of the submission at a meeting of Council on a date, time and place to be determined by Council.

Any person making a written submission, or exercising rights under Council’s Community Engagement Policy, is advised that all submissions or comments and personal information in the submission or comment will be handled by Council in accordance with the provisions of the Privacy and Data Protection Act 2014.

All submissions will be considered in accordance with section 223 of the Local Government Act 1989.

Following consideration of any and all submissions and compliance with Council’s Community Engagement Policy, Council will decide to discontinue and sell the road, discontinue and sell part of the road, or not to discontinue and sell the road.
