Notice of the preparation of an amendment to a planning scheme and notice of an application for a planning permit given under section 96C of the Planning and Environment Act 1987

This combined planning scheme amendment and planning permit application seeks to facilitate a mixed-use development on land in the Heritage Overlay (HO). In doing so, it proposes to restore and reuse a kiln and chimney of heritage significance.

Details of the amendment 

The Cardinia Shire planning authority has prepared Amendment C282card to the Cardinia Planning Scheme.

The land affected by the amendment is Lot AA PS814723 Cotswold Crescent, Officer VIC 3809

The amendment proposes to amend the Schedule to the Heritage Overlay (HO) to consider prohibited uses for HO104 and concurrently consider a planning permit application for land at Cotswold Crescent, Officer to facilitate a mixed-use development.

Specifically, the proposed amendment seeks to:

• Amend the Schedule to the HO to allow prohibited uses to be considered for HO104 (James Hicks Pty Ltd Pottery) by amending the ‘prohibited uses permitted?’ column to state ‘Yes’.

The application is for a permit approval for:

• Use of the land for office and food and drink premises;
• Buildings and works associated with the above uses, being development of the land with an office building, café, restaurant/wine bar and associated car parking;
• Construction and display of signage associated with the development;
• Reduction in the number of car parking spaces required;
• Creation of access to the Princes Highway (TRZ2).

The applicant for the permit is James Hicks Pottery Site Pty Ltd.

• on request, during office hours, at the office of the planning authority, Cardinia Shire Council at 20 Siding Ave, Officer VIC 3809, by contacting Planning Strategy and Urban Design Team on 1300 787 624 to arrange a time to view the amendment documentation.

Any person may make a submission to the planning authority about the amendment and the application. Submissions must be made in writing giving the submitter’s name and contact address, clearly stating the grounds on which the amendment and/or application are supported or opposed and indicating what changes (if any) the submitter wishes to make.

Name and contact details of submitters are required for planning authority to consider submissions and to notify such persons of the opportunity to attend planning authority meetings and any public hearing held to consider submissions.

The planning authority must make a copy of every submission available at its office and/or no its website for any person to inspect free of charge until the end of the two months after the amendment comes into operation or lapses.
