| "Abandoned or Derelict Vehicles" - also known as ABV's, are any unregistered vehicle or vehicles considered to be abandoned by a Local Laws officer.
LOCAL LAW NO.10 - PART 17 (37)
37.1 A person must not leavestanding on or in aroad a parking area or any land vested in Council any vehicle which:
37.1.1 is causing an unlawful obstruction; or 37.1.2 is unregistered or does not have a current registration certificate affixed to the windscreen; or 37.1.3 is registered and has been left standing for at least seven(7) consecutive days and has, in the opinion of an authorised officer, been abandoned; or 37.1.4 is adversely affectingthe amenity of the area in which the road, parking area or land is located.
37.2 If an Authorised Officer finds a vehicle which has been left standing in contravention of Clause 37.1, he or she may remove that vehicle from the road, parking area or land vested in Council, and take it to a place appointed by Council.
37.3 Council may release a vehicle to a person upon:
37.3.1 being satisfied that the person is the owner or an agent of the owner of the vehicle; and 37.3.2 payment of any fee fixed by Council.
37.4 If, after 30 days of a vehicle having been taken to a place described in Clause 37.2, the vehicle is not released in accordance with Clause 37.3, Council may:
37.4.1 cause the vehicle to be delivered to a municipal tip; 37.4.2 sell the vehicle by auction or public tender; or 37.4.3 dispose of the vehicle as it sees fit.
